Now that we are beginning to learn what was said in the inner councils – at meetings with the prime minister, at meetings of the ministerial security committee and at sessions of the Israel Defense Forces General Staff – it is becoming clear that our leaders just would not listen to opinions that were contrary to theirs while discussions were being held on the conduct of the Second Lebanon War. Prime Minister Ehud Olmert and then chief of staff Dan Halutz stubbornly clung to their fantasy that the war could be won from the air, while Foreign Minister Tzipi Livni thought that we could get the UN Security Council to pull us out of this mess by calling for a cease-fire, leaving Hezbollah undefeated. read more

Government to HCJ on State Commissions: Excuses for the Unjustifiable…

No Explanations, Just Excuses (Haaretz Editorial)

The High Court of Justice has asked the state to justify why no state commission of inquiry was appointed to examine the second Lebanon war, and why the less appropriate government review panel was chosen. But the state will not be able to justify it convincingly at the next hearing either, because only excuses can be made for the state’s behavior, not explanations.

Not a single good reason has been offered for preferring a government review panel, leaving only the obvious reason. A government review panel is more convenient for the government, both because the reviewers were appointed by the prime minister himself and because the government is not obligated to accept its recommendations or even to publicize them. read more

The Winograd Commission of investigation into the management of the war in Lebanon will be given the same authority as a state commission, Prime Minister Ehud Olmert said Sunday at the opening of the weekly cabinet meeting.

“It is the government’s intention to invest the committee with all the powers of a state inquiry commission, as required by law and according to the decision of the justice minister,” he said.

“I hope the committee will complete its task as quickly as possible and help the State of Israel better prepare itself for the challenges that await us,” Olmert said. read more

And just like all other “Israeli Commissions of Investigation” formed in the past, it will probably be one of stone-walling, whitewashing and skewing in favor of the Regime. Just like the commissions after the Yom Kippur War, after the Sabra and Shatilla Camps, after the shootings at Ma’arat Hamachpela in the early 1990s, after the Rabin Assassination, about illegal kidnapping by the Regime of the time of S’fardi infants in the hospital and on and on, Justice is never done, truth is never served by all of these so-called Blue Ribbon Israeli Commissions of Investigation. Report: Olmert Defied Lindenstrauss War Investigation

Prime Minister Ehud Olmert refused to testify before a panel called by State Comptroller Micha Lindenstrauss on the poor state of Home Front preparedness during the summer war against Hizbullah terrorists, a weekend report said. The incident occurred at the beginning of the year and Olmert’s testimony was a required part of the investigative process Lindenstrauss undertook.

The report is set to be submitted to the Knesset on Tuesday without input from Olmert. On Saturday night, several organizations called on Attorney General Menachem Mazuz to order Olmert to answer the questions posed to him on the matter by Lindenstrauss. read more

Regardless of how the High Court of Justice ultimately rules, its issuance of a show-cause order last week against the government’s refusal to establish a state commission of inquiry into the Lebanon war – thereby effectively asserting the power to overturn this decision – represents a major new encroachment on the powers of the other two branches of government.

The problem that bothered the court is undeniably real: By instead establishing a governmental inquiry committee, the government retained the power to appoint the committee’s members, meaning that it essentially hand-picked the very people who will be investigating its actions. And that, despite the unquestionably high character of the committee members actually chosen, obviously makes it harder for the investigation to earn public credibility. read more
