AG Mazuz: State Commission of Inquiry the Appropriate Way to Investigate Lebanon War…

Sources: AG Told PM State Commission Most Suitable, By Aluf Benn (Haaretz)

Excerpts;

Attorney General Menachem Mazuz informed Prime Minister Ehud Olmert that appointing a state commission of inquiry is the appropriate way to investigate the Lebanon war, government sources said Sunday.

The legal options were presented to Olmert in the Mazuz letter, which ran to three pages. The options included a state commission of inquiry or a clarification committee, both in accordance with the law on inquiry committees; a government review panel, in accordance with the law on government powers; a committee appointed by the defense minister, in accordance with the law on military jurisdiction; and a request that the state comptroller prepare a report. read more

Government to HCJ on State Commissions: Excuses for the Unjustifiable…

No Explanations, Just Excuses (Haaretz Editorial)

Excerpts;

The High Court of Justice has asked the state to justify why no state commission of inquiry was appointed to examine the second Lebanon war, and why the less appropriate government review panel was chosen. But the state will not be able to justify it convincingly at the next hearing either, because only excuses can be made for the state’s behavior, not explanations.

Not a single good reason has been offered for preferring a government review panel, leaving only the obvious reason. A government review panel is more convenient for the government, both because the reviewers were appointed by the prime minister himself and because the government is not obligated to accept its recommendations or even to publicize them. read more

High Court of Justice to Olmert Regime: Show-Cause Why No State Commission…

High Court: Why No State Commission?

Commentary;

Will all of Olmert’s excuses for forming the Winograd Commission rather than submitting to an independent State Commission fly with the Supreme Court? MB

Excerpts;

The High Court of Justice on Thursday issued a show-cause order and gave the state six days to explain why it had appointed a government committee of examination into the second Lebanese war instead of a state commission of inquiry headed by a Supreme Court justice.

A panel of three judges headed by Supreme Court President Dorit Beinisch ordered the state to explain what was the scope of the government committee’s powers to investigate a matter of “general national significance” and whether it was proper for the government to appoint a committee which would have to investigate those who appointed it. read more

Totally Lacking Moral Integrity or Principle, Mofaz Backs Off Support for State Commission…

Mofaz Backtracks on War Probe, By Gil Hoffman (Jerusalem Post)

Excerpts;

Transportation Minister Shaul Mofaz has changed his mind and will either abstain or vote in favor of the government commission Prime Minister Ehud Olmert formed to investigate the war in Lebanon, sources close to Mofaz said on Monday night.

Mofaz’s decision came a day after he became the first Kadima minister to call for a state commission of inquiry into the war. Olmert’s associates reacted angrily to Mofaz’s call, saying that Mofaz was more to blame than anyone else for the blunders of the war. read more

Will Comptroller’s Report Have Clout? Will an Independent Commission, Prosecutions Emerge?

Commentary;

Will today’s state comptroller’s report have teeth, clout?? Will it trigger the Knesset State Control Committee’s empowerment by law to order the appointment of a Judicial Commission of Inquiry on the Lebanon conflict?

The regime’s “senior defense officials said Tuesday that the country was prepared, ‘more than ever,’ for another war.” * They claim that;

“The IDF is prepared for a war today better than it was last year,” declared one defense official. “Combat units are trained and the Home Front Command is better prepared today to deal with a missile onslaught than it was last summer.” read more

Do State Comptroller’s Report, Winograd Final Spell New Elections?

Commentary;

It appears that Olmert’s end as prime minister may be coming close. Will the State Comptroller’s report oust him or will the final hammer blow come from the Winograd Committee final report? Or will Olmert either pull off a desperate “agreement” with Abbas or, maybe with
Assad which will solidify his power while seperating us from more Jewish land, causing expusion of more Jews and putting us all in dire peril? Or will Der Shlickster pull off another maneuver testifying to his total contempt for the rule of law and justice? MB read more

A Commission Born in Sin: Olmert’s Handpicked Committee

Our World: What Commissions Cannot Do, by Caroline Glick (Jerusalem Post)

“Ma’ariv reported protocols of cabinet meetings in the weeks which preceded the 2000 withdrawal where then IDF chief of staff Shaul Mofaz and then IDF OC Northern Command Gabi Ashkenazi begged Barak not to go through with the withdrawal precisely because the Hezbollah buildup and aggression were so predictable.”

Related report: Summary of the Winograd Committee Interim Report

Excerpts;

When thousands of IDF reservists were released from service at the end of last summer’s war they were angry and demanded an accounting from the Olmert-Livni-Peretz government and from the IDF’s General Staff. The reservists rightly felt that they and the country had been betrayed by failed political and military leaders who chose the wrong strategy, prosecuted it incompetently, and led the IDF and the nation to an ignominious defeat that could have been a victory if they had been less incompetent, arrogant and foolish. read more
