Commentary;

These words speak for themselves; i.e. “this may not be so in extreme cases.” Stern doesn’t define “extreme cases!”

“…The limited proportions of the phenomenon of refusal show that these questions may not and should not be asked when it is not essential.” And what if the proportions were larger???
