Peretz on Hevron Expulsion: I Have the Authority

Peretz Orders Hebron Building Evacuated, by Yaakov Katz (Jerusalem Post)

The occupants of a Hebron building… received orders from Defense Minister Amir Peretz Wednesday morning to evacuate themselves within 15 days.

However, Attorney-General Menahem Mazuz rejected the request to permit the immediate evacuation of the house.

Army Radio reported that in a meeting held Tuesday evening, Mazuz said that there is no security reason for the evacuation and that one cannot define the settlers as intruders. He emphasized that a more extensive legal procedure would be needed to allow petitions to be filed to the High Court in order to determine the case.

Meanwhile, Peretz declared Wednesday that “we cannot accept a situation where buying a house or a land deal will determine the settlement map. Entering areas in Judea and Samaria and the settlement map must be determined by government policy and therefore we intend to act in all legal ways to evacuate the building in Hebron.”

Peretz denied that his decision was motivated by political considerations.

“I am upholding the law. I am responding to the situation on the ground,” he said in an interview with Israel Radio.

The defense minister’s decision came after Mazuz published an opinion that the occupation of the structure by settlers was illegal. However, Mazuz apparently did not say that there was any legal backing for an immediate evacuation, Israel Radio reported.

Meanwhile, Industry, Trade and Labor Minister Eli Yishai will visit the disputed house in Hebron Wednesday, Army Radio reported.

“If the house was purchased legally, it is inconceivable that they will be evacuated,” Yishai said.

The defense minister was expected to charge the IDF’s coordinator of government activities in the territories, Maj.-Gen. Yosef Mishlev, with handling the evacuation.

The Jewish community of Hebron, meanwhile, objected to the decision and called on the government to stop what they referred to as the “anti-Semitic crime of removing Jews from their homes,” Israel Radio reported.

One of the students who moved into the hotly contested property in March dismissed claims by the Palestinian former owner that the house had not been sold, saying that the homeowner was telling the story “out of his fear of revenge from other Palestinians.”

Oren Zach told Army Radio in an interview that the sale had been carried out officially and legally, and that police were still investigating the ownership of the house due to the web of bureaucracy that complicates property issues in the West Bank area.

Zach expressed reassurance that the situation would not turn violent. “We came to the building to build the land of Israel. This is a happy day for us, since we’ve merited to redeem another place in the city of the patriarchs.”

Eitam told Olmert that evicting the building’s Jewish residents would be a blow to justice and the right of Jews to live in any part of Eretz Yisrael. “You cannot allow Peretz to cause an uproar over internal Labor Party issues, specifically his attempts to look good for voters in party primaries,” Eitam said, adding that he was sure that Olmert would keep his promise.

Commentary;

Yeah, right! This is another, “Believe it and I’ve got a bridge to sell you cheap.” Is Eitam stupid, or is he still naive enough after Amona to believe anything Olmert says? Olmert’s words are not worth soiled toilet paper! And Amir Peretz’s binocular caps are once again firmly attached. Notwithstanding Peretz’s denials of political considerations, he’s sooo far out on a limb this time that he cannot win and his days as Defense Minister are numbered — in the very few. MB
