Regardless of how the High Court of Justice ultimately rules, its issuance of a show-cause order last week against the government’s refusal to establish a state commission of inquiry into the Lebanon war – thereby effectively asserting the power to overturn this decision – represents a major new encroachment on the powers of the other two branches of government.

The problem that bothered the court is undeniably real: By instead establishing a governmental inquiry committee, the government retained the power to appoint the committee’s members, meaning that it essentially hand-picked the very people who will be investigating its actions. And that, despite the unquestionably high character of the committee members actually chosen, obviously makes it harder for the investigation to earn public credibility. read more

On the holy day of Rosh Hashanah, police brutally attacked Jewish worshippers at the extension of the Western Wall known as the “Small Western Wall” and arrested a Jew for blowing the traditional shofar (ram’s horn). The last time that a Jew was arrested for blowing the shofar at the Western Wall was in the 1920’s, during the British Mandate. It seems that an Arab living near the Wall complained that the noise was disturbing her children. It makes no difference that the Moslem calls to prayer are blasted over loudspeakers throughout the Old City of Jerusalem and in many other places in Israel five times a day, including at about 4 a.m. Even if that disturbs the sleep of some Jews, it is freedom of religion. But if the Jews blow the shofar at 7:30 a.m., that is a crime. In the State of the elites, Jews do not necessarily have the right to practice their religion. read more
